The UK Supreme Court has delivered its judgment in the Royal Mencap Society -v- Tomlinson-Blake case about payment for sleep in shifts.
The judgment which has taken more than a year to deliver was announced by Lady Arden this morning and said:
“This court dismisses the appeal of Mrs Tomlinson-Blake and Mr Shannon. “
“It follows that Mrs Tomlinson-Blake will be unable to bring action against Mencap to the extent it is based on unpaid arrears of remuneration. “
“Mr Shannon will, likewise, be unable to pursue his claim for damages”
